As reported by Tampa Bay Beacon, "There is not one easy process."
Martha Flynn said that to Manatee County commissioners in July, describing what it takes to get a short-term rental noise complaint routed to the right office in her Pine Meadow neighborhood in northwest Bradenton. She wasn't talking about real estate. She was talking about a dead-end call to code enforcement, then another to the sheriff's office, then a third guess at who actually handles this.
But the same fragmentation she was describing for noise complaints also describes something a buyer needs to understand before writing an offer on a Gulf Coast rental property near Anna Maria Island: whether that property can legally operate as a nightly rental depends entirely on which side of an invisible line it sits on, and that line is currently being redrawn.
Anna Maria Island is split into three separate municipalities, and each one has already answered the short-term rental question for itself. According to RASM, the City of Anna Maria's occupancy formula generally tops out at eight guests, and an annual inspection is required. Holmes Beach and Bradenton Beach have their own short-term rental registration requirements, as HomeTeam Luxury Rentals notes.
None of that is in dispute. Each of the three cities wrote its rules years ago, and each keeps enforcing them through its own registration system.
Step off the island into unincorporated Manatee County, and there is no equivalent to any of that. According to BNBcalc, unincorporated Manatee County had no county-specific short-term rental ordinance as of 2026. Commissioners first directed staff to draft one in January 2025. That effort died on a 3-3 vote in May 2025. It came back to life on June 16, 2026, when commissioners voted 5-0 to reopen the issue, and a revised draft went back to the board on July 7.
Then, at a September 2, 2026 work session, the conversation took a turn that has nothing to do with drafting new rules and everything to do with whether the old ones already apply.
A resident group called Manatee Concerned Residents, formed in June 2026 and now counting more than 1,200 members on Facebook, presented commissioners with a legal brief arguing that short-term rentals in Residential Single-Family zones have technically been prohibited since 1990. Their case traces back to the county's land development code, which defines a dwelling as intended for use by "one family only" and explicitly excludes hotels, boarding houses, and "any temporary lodging, boarding or rooming building or structure designed for transient residence." That language predates a 2011 state law that otherwise bars local governments from banning short-term rentals or regulating how long or how often a home can be rented, because the state law carves out an exception for any local rule adopted before June 1, 2011.
County staff told commissioners they'd only received the group's written argument a few days before the meeting and are now requesting a formal opinion from the county attorney's office. Development Services Director Nicole Knapp said the answer will take time. In the meantime, commissioners directed staff to pursue two paths at once: tighten enforcement of existing noise, trash, and parking rules while also drafting a new registration ordinance, the kind of both-and decision that reflects how unresolved the underlying legal question still is. Read the full account of that meeting from Your Observer.
The pocket of unincorporated county most affected by all of this sits directly against the island. West Manatee Fire Rescue, the district that handles life-safety inspections for short-term rentals, covers the barrier islands plus Cortez, Palma Sola, and Northwest Bradenton, the same mainland-adjacent neighborhoods where buyers shopping "near Anna Maria Island" often end up once island prices push them a few minutes inland.
Pine Meadow, where Flynn lives, is one of those neighborhoods. The HOA there has told commissioners that more than a quarter of its roughly 100 homes are now short-term rentals, and that five of them, advertising space for 13 to 20 guests, generate the bulk of the complaints. County code enforcement, meanwhile, is working through a backlog created by a hiring freeze that started in February 2026. Knapp told commissioners it currently takes about a week to get an inspector to a property. Staff estimated a fully staffed county rental program could cost roughly $1.5 million in its first year, a number Fox 13 Tampa Bay reported after a commission work session in August.
None of that changes what happens inside Anna Maria, Holmes Beach, or Bradenton Beach city limits. It does mean that a buyer comparing two similarly priced homes, one inside a city boundary and one a few blocks away in unincorporated Manatee, is not comparing two versions of the same rule. One property operates under a settled ordinance with a known inspection and registration process. The other currently sits inside a legal question that the county's own staff cannot yet answer.
Rental potential depends on the property's jurisdiction. Before writing an offer on a property positioned as an Anna Maria Island rental investment, it is worth confirming:
If I buy inside Anna Maria, Holmes Beach, or Bradenton Beach city limits, am I fully insulated from this fight? Those three cities regulate rentals through their own codes, separate from the county's land development code that Manatee Concerned Residents is challenging. Their ordinances aren't part of this dispute. That said, rules can still change over time within any city, so it's worth confirming registration status is current.
What happens to rentals already operating in unincorporated Manatee County if the county attorney agrees with the residents' legal argument? That's the open question, and neither county staff nor commissioners have said. Commissioner George Kruse noted during the discussion that the county has effectively let this go unaddressed for over a decade, but nothing has been decided.
How long before the county actually resolves this? Staff told commissioners they'd return within 30 to 45 days of the September 2 meeting with a transition plan covering what can be done immediately, while a full ordinance and the legal opinion on the 1990 dwelling definition will take longer. Anyone comparing rental income projections against a property in unincorporated Manatee should treat that timeline as unsettled rather than final.
Buying a Gulf Coast property for its rental potential means buying into whatever jurisdiction that parcel happens to sit in, and right now those jurisdictions are not behaving the same way even a few streets apart. If you're weighing a property near Anna Maria Island and want a clear read on which rules actually apply to it, Arlene Buckmaster can help you check before you write the offer, not after.
